Terms & Conditions:

  1. General: Terms and Conditions is in relation to the services offered by APA4U to its clients ("Client"). By agreeing to employ my services, it is understood that you have read and agreed to these Terms & Conditions.
  2. Definitions:
  1. Agreement: The Agreement referred to in Clause 1.
  2. Scope of Work: The specific details agreed between Client and APA4U in respect of implementing the services offered by APA4U. The Scope of Work is presented in the form of a quote by APA4U and agreed upon by both parties before commencement of work.
  3. Deliverables: All items prepared or required to be delivered as agreed between the Client and APA4U.
  4. Client: Every natural person or company who wishes to make use of APA4U services.
  5. Assistant: Any natural person appointed by APA4U providing services on my behalf to a Client.
  6. Website: The platform through which the Client can access general information about APA4U.
  7. Block of time: booked and payable by the hour.
  1. Independent Contractor: APA4U is and will remain as an independent contractor in its relationship with Client. Nothing in these terms and conditions shall be deemed to have created a partnership, or joint venture or a contract of employment between APA4U and Client.
  2. Copyright: The APA4U website content is copyrighted to APA4U. All logos and design cannot be copied, imitated or used without prior written consent from APA4U.
  3. Confidentiality & Nondisclosure: “Confidential Information” means information related to the business (including third party information), which (i) is subject to privacy rules and regulations and/or derives economic value, actual or potential, from not being generally known to or readily ascertainable by other persons who can obtain economic value from the disclosure or use of the information, (ii) is the subject of efforts by the Disclosing Party that are reasonable under the circumstances to maintain the secrecy of the information, and (iii) is identified by the Disclosing Party as “Confidential” and under all of the circumstances, ought reasonably to be treated as confidential under these Terms and Conditions. Neither the Client nor APA4U shall disclose to a third party any Confidential Information of the other party. The party receiving Confidential Information (“Receiving Party”) shall use the same degree of care and caution as it uses to protect the confidentiality of its own confidential information of like nature.
  4. Pricing: Fees for services can be obtained through an emailed request. APA4U reserves the right to change pricing at any time. For blocks of time (per hour), the full amount is payable upon presentation of invoice following completion of the work. Payment may be made via cash or EFT. APA4U is not a VAT vendor, and does not charge VAT.
  5. Non-payment: If the Client does not pay the entire outstanding amount within seven consecutive days of invoice date, APA4U reserves the right to take legal actions to claim the entire outstanding amount. All additional expenses incurred to complete the work will be charged to the Client.
  6. Limitation of Liability: In no event shall either party be liable for any indirect, incidental, special or consequential damages for loss of data or use, errors or omissions, incurred by either party or any third party, even if the other party has been advised of the possibility of such damages.
